Set the date in the agenda: Dec 10th, 2025.
Because you might have not received any notification about it but the Vereniging Tot Instandhouding van het complex Tuinwijk-zuid te Haarlem has been summoned in court, it is not a letter from my lawyer, this time, but the beginning of the proceedings in a tribunal.
My lawyer mr. Thomas ensures me, that normally associations do notify their members about such things but, hey! We’re the Free Republic of TW-Z, everything goes.
The association is summoned not just for the cancellation of the ridiculous fine that the members of the boards of the past 2-3 years would like to “punish me” with, possibly listening to the suggestions of those, like De Vries, Van Zetten, Hintz et al. who believe I am the one in the wrong. That is as good as gone.
The summon is mainly for the violation of art. 2:8 BW.

Basically the law prescribes that members of an association must behave with each other in fairness and honesty.
Guess what? I do not believe that to have been the case, hence the summon!
But it’s not so easy, as I explained here .
Still, my lawyer and I are happy to be here, after years of attacks and discrimination. Aren’t you?
Because the board, in the person of mvr. Inge Groot, has tried, in her own silly way, to come to a last-last-last-, very-last minute (two days ago) proposal for extra-judiciary settlement: via their lawyer they have proposed the payment of the summoning costs (some 640 euros) and the cancellation of the fine.
I believe it will amount, with the legal costs you already incurred in, to some 3 euros more per month per unit, for a year.
My idea is quite different: while I am not punishable since I have not committed any wrongdoing, in the eyes of an independent, external authority, you are seriously at risk to be condemned for violation of art. 2.8 BW and THEN sued for the damages.
And more.
Therefore: the association “generous” (indecent?) offer is obviously rejected, my counter proposal very simple:
-my legal expenses fully covered (as there would have been none should some members have behaved with simple decency);
-my troubles and loss of “woongenoot” compensated;
-written apologies, to stay on the server “secula seculorum”;
-immediate resignation of the present board.
You can relect them later, if you really, REALLY like them!
MEANWHILE, good news! I’ve been doing fine, thanks, and I’m starting shooting for MY DOC ON TUINWIJK-ZUID AND BEYOND!
